  • Indirect Interest in 11 Properties Throughout Bayonne, East Rutherford, North Bergen, Fort Lee, Passaic, Jersey City & Wallington, New Jersey
  • Diligence materials are available upon request and execution of standard confidentiality and non-disclosure agreement.
  • PLEASE TAKE NOTICE, that in accordance with applicable provisions of the Uniform Commercial Code as enacted in New York, by virtue of certain Event(s) of Default under those certain Pledge Agreement(s), dated as of October 31, 2022 (the “Pledge Agreements”), executed and delivered by AG Equity LLC, 159 Market St LLC, 5 Third St LLC, Steven Gelbtuch and  Naftali Amsel (collectively, the “Pledgors”), and in accordance with their rights as holder of the security, Golden Towers, LLC (the “Secured Party”), by virtue of those certain UCC-1 Filing Statements made in favor of Secured Party, in accordance with Article 9 of the Uniform Commercial Code of the State of New York (the “Code”), Secured Party will offer for sale, at public auction, (i) Pledgors’ 100% membership interest in and to South Street Apartments LLC, 1 Third Street LLC, 90 Mercer LLC, 86 West 24th LLC, 171-174 Market St LLC, 80 4th St LLC, 159 Market St LLC, 240 Paterson Ave LLC, 309 Oak St LLC, 1215 7th Apartments LLC, Booraem Holdings LLC, and Garfield Avenue Holdings LLC (collectively, the “Pledged Entities”), and (ii) certain related rights and property relating thereto (collectively, (i) and (ii) are the “Collateral”).
  • Secured Party’s understanding is that the principal assets of the Pledged Entities are certain fee interest in real property commonly known as (i) 125 South Street, Passaic, NJ (the “South Street Property”); (ii) 84-86 West 24th Street, Bayonne, NJ (the “W24ST Property”); (iii) 240 Paterson Avenue, East Rutherford, NJ (the “Paterson Ave Property”); (iv) 1215 7th Street, North Bergen, NJ (the “7th Street Property”); (v) 80 4th Street, Passaic, NJ (the “4th Street Property”); (vi) 810 Abbott Boulevard, Fort Lee, NJ (the “Garfield Ave Property”); (vii) 1-3 Third Street, Passaic, NJ (the “Third Street Property”); (viii) 159, 171, 172 and 174 Market Street, Passaic, NJ (the “Market Street Property”); (ix) 309 Oak Street, Passaic, NJ (the “Oak Street Property”); (x) 141 Booraem Avenue, Jersey  City, NJ (the “Booraem Ave Property”); and (xi) 90  Mercer  Street,  a/k/a 91 Wallington Avenue, Wallington, NJ (the “Mercer Street Property”) (collectively, the “Property”).
  • Maltz Auctions (“Maltz”), under the direction of Richard B. Maltz or David A. Constantino (the “Auctioneer”), will conduct a public sale consisting of the Collateral (as set forth in Schedule A below), via online bidding, on July 22, 2025 at 1:00pm, in satisfaction of an indebtedness in the approximate amount of $5,714,702.10, including principal, interest on principal, and reasonable fees and costs, plus default interest through July 22, 2025, subject to open charges and all additional costs, fees and disbursements permitted by law.  The Secured Party reserves the right to credit bid.

Bidder Qualification Deadline: Monday, July 21 by 3:30 PM.  Executed Terms & Conditions of Sale along with a deposit in the amount of ten (10%) of Bidders’ intended bid amount via wire transfer are required for consideration by any interested party.

Auction Date & Time: Tuesday, July 22, 2025 at 1:00 PM EST.
