Overview of Sales Process: This is a two-step bidding process. The first step is the submission of binding, sealed bids that are due by 5:00 p.m. on Monday, November 26, 2018. The qualified bidders will be invited to bid at the live auction on Thursday, November 29, 2018 at 11:30 a.m.
Sealed Bid/Bidder Qualification Deadline: Monday, November 26, 2018 before 5:00 pm. The required Qualifying Packet (as defined within the Bidding Procedures) and required $350,000 deposit (cashier’s check) must be included for consideration. See attached Bidding Procedures and Sale Agreement for details.
Sealed Bid Delivery Location: Yann Geron, Chapter 7 Trustee, c/o Reitler Kailas & Rosenblatt LLC, 885 Third Avenue, 20th Floor, New York, New York 10022 with a copy of the bid to Maltz Auctions, 39 Windsor Place, Central Islip, New York 11722.
Auction Date & Time: Thursday, November 29, 2018, at 11:30 a.m. (Registration commences at 10:30 am). Only bidders who have been deemed to be Qualified Bidders, as defined in the Bidding Procedures, will be qualified to participate at the auction.
Auction Location: United States Bankruptcy Court for the Eastern District of New York, Alfonse M. D’Amato Federal Courthouse, 290 Federal Plaza, in Judge Scarcella’s Courtroom (No. 970), Central Islip, New York 11722.
Terms & Conditions of Sale: The Sale of the Property is in “as is” and “where is” condition, free and clear of all liens, claims, and encumbrances, other than Permitted Encumbrances (as that term is defined in the Sale Agreement), with any such liens, claims, and encumbrances to attach to the Sale proceeds.
